In 2009, significant regulatory changes took effect for 403(b) retirement plans. These complex and hefty new rules require tax-exempt 403(b) sponsors to fill the "vacuum of responsibility" - to maintain plan documents, monitor investment choices and plan assets, submit annual filings to the IRS, and comply with several other new regulatory requirements. Plans that cover 100 or more participants are now also subject to independent audits, and all nonprofit employers must serve as primary fiduciaries for their 403(b) plans. Are you in compliance? Are you doing everything you should?
